What to Do if You Get Pulled Over for a DUI in Texas

There’s a certain anxiety to getting pulled over by a police officer, but most of those interactions tend to be simple and quick. However, everything changes when you’ve had a few drinks at dinner or with friends and you see those lights in your rearview. Suddenly, frantic worry fills your head, typically followed by the infamous “DUI” acronym. The reality of being arrested for those few drinks you had suddenly becomes very possible. What should you do? The following tips can help you know what to do if you get pulled over for a DUI in Texas.

Don’t Drink and Drive

The easiest and 100% guaranteed way to avoid a DUI conviction is to avoid driving after you’ve been drinking. The intent of this blog post is to inform you of the Constitutional rights you are entitled to when you are pulled over on suspicion of a DUI, not to condone drunk driving in any way, shape or form. Drunk driving is a serious offense, and ultimately it’s better for you and others to avoid it altogether. Call an Uber or hitch a ride home with a designated driver. It will save you the time, money and stress of a DUI conviction. And it could save lives, both yours and those of the people around you.

Stay Silent and Polite

One of the first questions the officer will ask you after pulling you over is if you know why they pulled you over in the first place. You may or may not know the reason, but it’s important to remember that you don’t have to answer. Every word you say and action you take from here on out can result in a guilty conviction, so take care in what you say and how you say it. Politely tell the officer that you have nothing to say. Asking something as simple as where you’re coming from can lead to the inevitable assumption that you’ve been drinking. The officer can then use your answer, and the way you say it, to indicate on their report that they think you’ve been drinking. The same goes for the way you act. If you’re upset and display that anger, it’s a simple enough assumption that you’re drunk and at that point, you’re just helping their case against you. Stay as silent as you can and always act politely.

Don’t Take the Field Sobriety Tests

Contrary to popular belief, you are not required by law to take field sobriety tests. In fact, these tests aren’t designed to be pass or fail; they are designed so the officer can identify clues that may indicate impairment. If the officer has already made up their mind that you’re drunk, they’ll find those clues even if you perform well on these tests.

Note that while field sobriety tests are not required, if you are arrested, you will be required to take a breathalyzer test at the police station. This is required by law, and if you refuse, you could receive refusal charges.

Bonding out of Jail on Class C Warrants

We’re writing today about getting people out of jail on Class C warrants. A lot of people get tickets and then for whatever reason they forget about them, they don’t handle them. Now maybe this doesn’t describe you but if it describes you or someone you know, someone you’re trying to get out of jail then you’re gonna need to hear this. If you get arrested on warrants you can, …. people can have warrants all over the Metroplex. If you were driving around without a license, without insurance, without an inspection or registration sticker and you were speeding, then every time you get stopped you’re going to get four or five tickets and then if you’re the type of person who doesn’t take care of those tickets, then you’re going to have four or five warrants everywhere you got stopped. So, you’ll have multiple agencies that want you in the sense that they want you in their court. And those warrants will hold you in jail until they’re taken care of.

Now, what happens if you don’t do anything is you bounce around from jail to jail over a period of days, sometimes even a period of weeks taking care of these warrants, sitting them out or paying them off or doing whatever it takes just to try to get out of jail. And so, if that describes you well, call us before you get arrested and we can help you get that stuff cleared up so that you don’t get stuck in jail.

But if you do happen to already be stuck in jail, call us, … have a relative call us and we’ll talk to them about what it’s going to take to get you out, to strategize regarding how we’re going to get you released from the claws of all these cities that are trying to grab you. And you know, even if you need nothing more than advice, we can give that to because a lot of these tickets, if you just try to sit them out, yeah, you may be using your time to pay off tickets at a rate that might be even more than you make in a day, but you’re going to be shooting yourself in the foot a lot of ways. You’re going to be damaging your driving record, getting yourself surcharges, possibly license suspensions and digging a much deeper hole for yourself when it comes to trying to get a valid license.

Now, getting a valid license and having good insurance and keeping your car registered and inspected, those are ways to keep from getting four or five tickets every time you get stopped. Then if you get stopped you get one ticket for the traffic offense and you also, you know, a lot of agencies won’t even write you four or five tickets. They’ll just take you straight to jail

Fugitive From Justice Writs (FFJ Writs)

Today we’re writing about Fugitive from Justice Writs. Now what is a Fugitive from Justice Writ (FFJ Writ) and why might you need one? If you need one, you’ll need one very badly because it means you have someone in jail here on an out-of-state warrant. The idea is that they will be transferred to that other state or extradited on that warrant. And the reason that’s not a good thing is because then you’re at the mercy of someone else’s schedule and the amount of time it takes can extend into weeks maybe even longer.

If you can get your person out of jail here and let them then respond to that other state in their own way, it allows them to be in control of their life and also keep things like jobs, relationships, families, homes… Those sorts of things can be lost to people who get stuck in jail. So this helps them get out and respond to the other state on their own time, on their own schedule. It’s important that they go ahead and respond to the other state so this doesn’t happen again or get worse, but at least when they bond out here on a Fugitive From Justice Writ they can hopefully arrange to handle the matter without being dragged across the country and held for weeks.

So, it’s important if you need a Fugitive from Justice Writ that you hire someone who knows how to do it. It’s not the kind of thing you want your lawyer learning on the job.
